Welcome to Telly Tale! By purchasing, using, or accessing the Telly Tale Phone ("Device"), you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

1. Purpose of the Device

The Telly Tale Phone is intended to be a communication and educational tool. It is designed to provide users with features that promote connection, creativity, and learning. The Device is a tool only, and how it is used is ultimately the responsibility of the purchaser, parent, guardian, or user.

2. User Responsibility

By purchasing or using the Device, you acknowledge that:

  • You have independently researched the Telly Tale Phone and its features before making your purchase.

  • You understand the capabilities and limitations of the Device.

  • You accept full responsibility for how the Device is configured, monitored, and used.

  • Parents and legal guardians are solely responsible for supervising minors and determining whether the Device is appropriate for their child.

Telly Tale cannot make parenting decisions or monitor how the Device is used after purchase.

3. Assumption of Risk

The purchaser and user assume all risks associated with the use of the Device.

Telly Tale is not responsible or liable for any actions, behaviors, communications, content, or consequences resulting from the use or misuse of the Device, including but not limited to:

  • Inappropriate communication between users.

  • Cyberbullying or harassment.

  • Exposure to third-party content.

  • User-generated content.

  • Improper supervision by parents or guardians.

  • Accidental or intentional misuse of the Device.

  • Any emotional, physical, financial, or legal consequences arising from use of the Device.

The Device is a tool, and its impact depends entirely on how it is used by the individual user and/or supervising adult.

4. Parental Supervision

If the Device is used by a minor, the parent or legal guardian agrees to:

  • Supervise the child's use of the Device.

  • Establish appropriate rules for its use.

  • Monitor communications when appropriate.

  • Teach responsible digital citizenship and online safety.

Telly Tale does not guarantee the behavior of any user or third party.

5. No Guarantees

While Telly Tale strives to provide a safe and enjoyable product, we do not guarantee that use of the Device will:

  • Prevent inappropriate interactions.

  • Eliminate online risks.

  • Produce specific educational or developmental outcomes.

  • Be uninterrupted or error-free.

Technology should always be used alongside appropriate adult guidance.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Telly Tale, its owners, employees, affiliates, manufacturers, distributors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to:

  • Use or inability to use the Device.

  • Misuse of the Device.

  • Unauthorized access or modification of communications.

  • Third-party actions.

  • Decisions made by users while using the Device.

  • Any injury, loss, damage, or claim resulting from the Device's use.

Your sole remedy for dissatisfaction with the Device is to discontinue its use, subject to any applicable warranty or return policy.

7. Product Information

Telly Tale makes every effort to accurately describe the Device, its features, and intended use. However, it is the purchaser's responsibility to ensure the Device meets their individual needs before purchasing.

By completing your purchase, you confirm that you have reviewed the available product information and conducted sufficient research to make an informed purchasing decision.

8. Compliance with Laws

Users agree to operate the Device in accordance with all applicable local, state, federal, and international laws and regulations. Users are solely responsible for any unlawful use of the Device.

9. Indemnification

You agree to defend, indemnify, and hold harmless Telly Tale, its owners, employees, affiliates, manufacturers, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Device.

  • Violation of these Terms & Conditions.

  • Violation of any law or rights of another person.

  • Use of the Device by any minor under your supervision.

10. Updates to These Terms

Telly Tale reserves the right to modify these Terms & Conditions at any time. Continued use of the Device following any updates constitutes acceptance of the revised Terms.

11. Acceptance

By purchasing, activating, or using the Telly Tale Phone, you acknowledge and agree that:

  • You have read these Terms & Conditions in their entirety.

  • You have conducted sufficient research to understand the Device and its intended use.

  • You understand that the Telly Tale Phone is a tool and that Telly Tale cannot control or supervise how it is used after purchase.

  • You accept full responsibility for the Device's use by yourself or anyone to whom you provide access.

  • You release Telly Tale from liability for any damages, injuries, losses, or claims resulting from the misuse, improper use, or unsupervised use of the Device, except where liability cannot legally be excluded under applicable law.

12. No Return Policy

All sales are final. Due to the nature of the Telly Tale Phone, we do not accept returns, exchanges, or offer refunds once an order has been placed or the Device has been shipped, except where required by applicable law.

Please review all product descriptions, specifications, compatibility requirements, and features carefully before making your purchase. By completing your purchase, you acknowledge that you have conducted sufficient research to determine that the Telly Tale Phone meets your needs.

Returns or refunds will not be granted for reasons including, but not limited to:

  • A change of mind.

  • Purchasing the wrong product.

  • Failure to read the product description or Terms & Conditions.

  • User preference after receiving the Device.

  • Lack of compatibility with expectations that were not expressly stated by Telly Tale.

If your Device arrives damaged, defective, or you receive the incorrect item, you must notify Telly Tale within 7 days of delivery by contacting our customer support team. We will review the issue and, where appropriate, repair, replace, or otherwise resolve the matter in accordance with applicable consumer protection laws.

Nothing in this policy limits any rights you may have under applicable law that cannot legally be waived.

By proceeding with your purchase or use of the Device, you indicate your acceptance of these Terms & Conditions.
